State regulators ruled the 6-million-square-foot campus constitutes a banned "heavy industrial use" due to the pollution risks of its 516 backup diesel generators and 2.5-million-gallon fuel farm. While New Castle County exempted the project from strict new local zoning rules, local carve-outs cannot override state environmental laws.

Starwood plans to appeal the decision in the Delaware Superior Court, a move expected to delay its planned 2026 construction by up to three years in legal battles.
